BACKGROUND INFORMATION
Sharon Coney was a non-instructional food service worker and bus aide from 2013 through 2018. Based on the results of a required five-year background rescreening, it was discovered that Ms. Coney did not meet the Level 2 requirements necessary for an employee in her position due to a prior conviction. The matter was referred to the Division of Administrative Hearings, a formal evidentiary hearing was conducted, and the Administrative Law Judge found that the School Board proved by a preponderance of evidence that the termination was warranted pursuant to Florida Statute. However, the Judge noted that Ms. Coney may qualify for a statutory exemption from employment disqualification due to the age of her prior conviction, which may be granted at the discretion of the School Board.
The Division of Administrative Hearings issued a Recommended Order, which must be approved, rejected, or modified by the School Board in a Final Order.
