BACKGROUND INFORMATION

In 1951, the School Board entered into a 99-year lease agreement with Monroe County for an approximately 3.5 acre parcel of property located on Upper Matecume Key, MM 81. The Lease Agreement was premised on the condition that the property be utilized by the County as a youth/community center or for other public purposes. During its occupancy of the property, the County built a Fire Station and Public Library on the property. Shortly after the Lease was entered into, it was amended by agreement to exclude a .25 acre parcel that the School Board ultimately conveyed ownership of to Mosquito Control. In 1998, the County entered into an interlocal agreement with the Village in which the County's interest in the property was conveyed to the Village in three components: (1) the "Library Park;" (2) the "Hurricane Monument;" and (3) the "Fire Station." While the ILA correctly conveyed the County's lease interest in the Hurricane Monument and Fire Station, it improperly attempted to convey an ownership interest in the Library Park to the Village. After a thorough review of the ILA and supporting documentation, the Village has agreed that ownership of the Library Park did not legally pass to them from the County. Accordingly, legal counsel for both the School Board and the Village have drafted a renewed lease agreement to simplify the arrangement pertaining to the Upper Matecumbe property, continuing the term of the existing lease. The Village Council will review the proposed Lease Agreement on October 10.

As the .25 acre "Mosquito" parcel was reconveyed to the School Board by Mosquito Control in 2018, it will now become part of the renewed Lease Agreement with the Village. The "Mosquito" parcel will also be recombined with the rest of the Upper Matecumbe property into a single parcel.
