Approval of Amendment No. 2 to Somerset Charter Agreement
BACKGROUND INFORMATION
On or about July 1, 2011, MCSD entered into a Charter Agreement with Key West Independent Education, Inc. for the operation of a charter school in Key West, now owned and operated by Somerset Academy Inc. (d/b/a Somerset Island Preparatory). The Charter Agreement was entered into for a ten year term, currently set to expire July 15, 2021. On February 17, 2021, representatives of Somerset Academy provided notice via email of their intention to renew the Charter Agreement, though no proposed renewed Charter Agreement was provided by the school prior to the agenda deadline for the March 9 meeting of the School Board. Florida Statute requires that the School Board afford charter schools at least 90 days notice prior to its decision to renew, non-renew or terminate any charter agreement. Due to the schedule of School Board Meetings with only a single March meeting, the soonest the proposed charter renewal could be placed on the agenda was April 13, 93 days before the current term of the Somerset Charter Agreement is set to expire. As the Board has previously stressed the importance of allowing it sufficient time to fully review proposed charter renewals, Amendment No. 2 is recommended for the Board's approval. Approval of the Amendment will extend the deadline for notice of the Board's decision on the renewal, allowing the Board to workshop the proposed renewed charter agreement at the April 13 meeting before voting on the proposed renewal at the April 27 meeting.
